Archer Health ("Archer," "we," "our," or "us") is committed to protecting the privacy and confidentiality of your protected health information ("PHI") in compliance with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and applicable state privacy laws.
1. Our legal duty
We are required by law to:
- Maintain the privacy and security of your PHI.
- Provide you with this Notice describing our legal duties and privacy practices regarding your PHI.
- Follow the terms of the Notice currently in effect.
- Notify you in the event of a breach of unsecured PHI.
2. How we may use and disclose your PHI
We may use and disclose your PHI for the following purposes without your authorization:
Treatment
To provide, coordinate, or manage your healthcare. For example, we may share your PHI with specialists, labs, or pharmacies involved in your care.
Payment
To obtain payment for services, including verifying coverage, billing, and collection activities.
Healthcare operations
For activities necessary to operate Archer, including quality improvement, training, accreditation, audits, and care management.
Required by law
When required by federal, state, or local law (e.g., reporting child abuse, communicable diseases, or in response to a valid subpoena).
Public health and safety
To prevent or control disease, report adverse drug reactions, or address serious threats to health or safety.
Health oversight
To health oversight agencies for activities authorized by law (audits, investigations, inspections, licensure).
Workers' compensation
For workers' compensation claims as authorized by law.
Business associates
To service providers (e.g., electronic health record vendors, billing services) who perform functions on our behalf and have signed business associate agreements requiring them to protect your PHI.
3. Uses and disclosures requiring your authorization
The following uses and disclosures require your written authorization:
- Most uses and disclosures of psychotherapy notes.
- Uses and disclosures for marketing purposes.
- Sales of PHI.
- Other uses and disclosures not described in this Notice.
You may revoke an authorization at any time, in writing, except to the extent we have already acted in reliance on it.
4. Your rights
Right to inspect and copy
You have the right to inspect and obtain a copy of your PHI in our designated record set. We may charge a reasonable fee for copying.
Right to request amendment
You may request that we amend your PHI if you believe it is inaccurate or incomplete. We may deny the request in certain circumstances and will provide a written explanation.
Right to an accounting of disclosures
You may request a list of disclosures we have made of your PHI for purposes other than treatment, payment, or healthcare operations.
Right to request restrictions
You have the right to request restrictions on certain uses and disclosures of your PHI. We are not required to agree, except in limited cases (e.g., when you pay for services in full out-of-pocket and request that we not disclose to your health plan).
Right to confidential communications
You may request that we communicate with you about medical matters in a particular way or at a particular location. We will accommodate reasonable requests.
Right to a paper copy of this notice
You have the right to obtain a paper copy of this Notice at any time, even if you have agreed to receive it electronically.
Right to be notified of a breach
You have the right to be notified following a breach of your unsecured PHI.

6. Complaints
If you believe your privacy rights have been violated, you may file a complaint with us using the contact information above. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights:

7. Changes to this notice
We reserve the right to change this Notice and to make the new provisions effective for all PHI we maintain. The current Notice will be posted at our facility and on our website.
